Stockwoods lawyer Aaron Dantowitz represented the Ontario College of Pharmacists in a case before the Superior Court of Justice concerning the constitutionality of the mandatory revocation regime in Ontario’s Health Professions Procedural Code. Under the regime, a health professional’s certificate of registration must be revoked upon a finding of professional misconduct involving certain forms of sexual interaction with a patient. The case raised the question of whether the Ontario legislature had the power to enact the regime, or whether it was essentially criminal legislation, and therefore within the exclusive jurisdiction of the Parliament of Canada.
