Fredrick Schumann succeeds in striking out claim against Law Society

Stockwoods lawyer Fredrick Schumann represented the Law Society of Upper Canada in a motion to strike a claim against it by a dismissed articling student. The plaintiff alleged that the Law Society had a duty of care to ensure that articling placements were not terminated without sufficient reason. Justice E. Morgan of the Superior Court of Justice accepted the Law Society’s arguments and struck out the claim against it, without leave to amend. The decision is available online.
