Scott Hutchison and Brennagh Smith appear in Supreme Court of Canada

Stockwoods lawyers Scott Hutchison and Brennagh Smith appear this week in the Supreme Court of Canada for the Criminal Lawyers’ Association.  The CLA has intervened in the case Judy Ann Craig v. Her Majesty the Queen. The case considers whether orders for forfeiture of offence-related property should be considered punishment for the purpose of sentencing. At issue is whether in deciding if an order for the forfeiture of offence-related property should be made (in this case, the residence of a 58-year-old woman convicted of operating a grow operation from her home), a court must take into account other sentences imposed on a convicted person such as fines or incarceration.  The Globe and Mail has reported on the case.
