Stockwoods’ lawyers successfully defend Norwich application

Stockwoods’ lawyers Paul Le Vay and Justin Safayeni, working with co-counsel Peter Jacobsen and Tae Mee Park of the Bersenas Jacobsen firm, successfully defended the Globe & Mail and journalist Sinclair Stewart in an application which sought disclosure of certain confidential unnamed sources quoted in an article written in 2008 by Mr. Stewart about the BCE takeover transaction.  The applicant had sought the information in order to add the sources as defendants in a class proceeding which alleges that the statements were misleading and constituted breaches of the Ontario Securities Act.   The Court held that the evidence of breach of securities law was minimal to non-existent and that the public interest in protecting journalist-source privilege far outweighed any public interest in ordering disclosure.   To read the decision, click here.
