Representative Work

Represented Selena Stronach in an arbitration over the valuation of her ownership share in 1/ST Racing. Succeeded at the arbitration in a high-value award, which was affirmed on judicial review.

Counsel for a holding company of David Thomson in the Hudson’s Bay Company CCAA insolvency in its successful bid to purchase the Royal Charter of 1670.

Acting for one of the trustees of the Sherman Family trust in estates-based litigation surrounding control of a multimillion-dollar trust.

Acted for Sailingstone Capital Partners LLC (a US-based hedge fund) in an international arbitration regarding a mine in Mongolia worth approximately $20 billion USD.

Representing a company in a multimillion-dollar construction arbitration related to the Stellantis/LG battery plant in Windsor, Ontario.

Acted in an international arbitration for Beam Communications Inc., an Australian publicly traded company, in a multi-million dollar dispute with its joint venture partner regarding ownership of the joint venture company.

Acted for Continental Bank in a landmark decision on the remedy for breach of privilege in civil proceedings that resulted in the plaintiff’s multi-million dollar lawsuit being extinguished: Currency Exchange Canada Inc. v. Sprott, 2023 ONCA 61.

Acted for Ernst & Young in its role as court appointed Monitor in the CCAA proceedings arising from the insolvency of Carillion Canada Inc., which, among other issues dealt with the treatment of approximately $28.8 million of funds that were the subject of competing trust claims under the Construction Act and cash sweep/set off rights under Carillion’s banking arrangement with HSBC.
