Stockwoods Lawyers Successfully Resist Judicial Review for the Law Society

Stockwoods partners Paul Le Vay and Owen Rees successfully resisted an application for judicial review on behalf of the Law Society of Upper Canada. The licensee brought an interlocutory application for judicial review alleging that a Law Society hearing panel had breached her rights to procedural fairness and violated her French language rights. Stockwoods argued that the application was premature and the Divisional Court dismissed the application on that basis. The reasons of the Divisional Court include important law regarding prematurity, exhausting statutory appeals, statutory French language rights, and the proper role of interveners.
