Stockwoods’ lawyers Gerald Chan and Alexandra Heine successfully defended a client charged with various counts of sexual assault, assault, and voyeurism in the Ontario Court of Justice in Ottawa. After weeks of trial dates spanning October 2025 through April 2026, multiple pre-trial and mid-trial motions (including a search warrant “Garofoli” challenge, a summary dismissal “Haevischer” motion, and motions regarding private records and prior sexual activity), the trial judge found that the client’s right to trial within a reasonable time under s. 11(b) of the Charter had been violated because of the expansion of the scope of the prosecution. As a result, the trial judge stayed all of the charges and terminated the prosecution in favour of the firm’s client.
