Stockwoods successfully defends clients in alleged price-fixing conspiracy class action

On Friday, the Federal Court dismissed the certification motion in Eaton v Teva et al, a proposed class proceeding alleging an industry-wide conspiracy to fix prices in the generic prescription drug market, and seeking multi-billion dollar damages.

Stockwoods lawyers Fredrick Schumann, Ryann Atkins and Adam Donaldson represented a group of defendants. On behalf of the joint defence group, Fredrick conducted the cross-examination of the plaintiff’s expert in health care policy and economics.

At the certification hearing, plaintiff’s counsel withdrew their request for certification against our clients, and the action against them was dismissed, with prejudice.
