Stockwoods lawyers Paul Le Vay and Justin Safayeni persuaded O’Neill J. to reject an effort by a plaintiff to conduct its own forensic examination of the computer systems of the defendant, Stockwoods’ client Direct Energy. The Court was satisfied that Direct Energy had conducted an adequate examination. The Court went on to emphasize that the plaintiff was seeking full access to the computer systems of its competitor, as well as the principle of proportionality in discovery.
