Today the Divisional Court released its decision, overturning the order of Perell J., and finding that rooming house tenants in Parkdale could proceed with their class action against the City of Toronto. Between 2003 and 2008, the City failed to send legally-required notices to these tenants informing them of their right to a rent reduction, as a result of property tax cuts of up to 66% given to their landlords as part of the Parkdale Pilot Project. The Court rejected the conclusion that the City did not owe a duty of care to these tenants, and ordered that the action be certified as a class proceeding.
