Divisional Court upholds Ontario College of Pharmacists Discipline Committee decision

Stockwoods lawyers Brian Gover and Aaron Dantowitz successfully represented the Ontario College of Pharmacists in an appeal by the Attorney General of Ontario from a decision of the Discipline Committee of the College, which involved the interpretation of certain provisions of the Health Professions Procedural Code.  Stockwoods successfully argued on behalf of the College that, given that the Discipline Committee was interpreting its home statute, its decision should be reviewed on the deferential standard of reasonableness.  To read the decision, click here.  Stockwoods was also successful in resisting an effort by the Attorney General of Ontario to obtain an order requiring the Discipline Committee to decide a constitutional issue in the case, which the College and the pharmacist whose conduct was in issue had agreed to have determined by a court.  To read that decision, click here.
