Divisional Court upholds Ontario Energy Board penalties against Summitt Energy Management

Stockwoods lawyers Phil Tunley and Andrea Gonsalves succeeded before the Divisional Court in a challenge to administrative penalties, compliance orders and compensation payments ordered against Summitt Energy Management Inc., a retail energy marketer, following a series of consumer complaints.  In its challenge to the Board’s order, Summitt challenged the Board’s procedures and legal conclusions on seven different grounds, including an allegation of bias.  In comprehensive reasons released April 9, the Court rejected all of Summitt’s grounds for review and upheld the Board’s decision.  To read the Court’s reasons, click here.
