Acting as a court-appointed amicus curiae, Stockwoods lawyer Justin Safayeni’s submissions on the application of the Civil Remedies Act to the sailboat Kittiwake, where the sole underlying criminal offence was the impairment of its sailor, were relied on in the Court’s decision to dismiss the Crown application for forfeiture.
